Covenants, By-laws and Articles of Incorporation

The Covenants are legal instruments that are recorded in the official land records office for Charleston County and should have been provided by your attorney at closing (if you did not receive them, they are available in several forms from the KICA office). On Kiawah Island there are two main sets of covenants that apply to all properties, except for some grandfathered properties along Eugenia Avenue. These two sets of covenants are:

  • Declaration of Covenants and Restrictions of the Kiawah Island Community Association Inc. (KICA or Association Covenants)
  • Declaration of Rights, Restrictions, Affirmative Obligations and Conditions Applicable to All Property in Kiawah Island (General or Developer Covenants)

Both of these are available to KICA members on CD-ROM, as PDF file to download or in paper form. Included in the KICA Covenants are the association by-laws, which deal with matter of corporate structure, and amendments that have been approved by the association's members over the years.

General (or Developer) Covenants

Listed below are the covenants of the master developer, KP (Kiawah Partners). Please note that many regimes and subdivisions (an example of a subdivision is Ocean Oaks) have additional developer covenants, too numerous to post.
